These Terms of Service (“Terms”) govern access to and use of www.libidai.com, the Libidai mobile application, and any related services, products, features, content, support channels, and digital experiences that link to these Terms (collectively, the “Services”).

you have the legal capacity to enter into a binding agreement

3. Accounts

3.1 Account creation

Some parts of the Services may require an account. You agree to provide accurate, current, and complete information and to keep that information updated.

3.2 Account security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account, except where liability cannot lawfully be placed on you.

You must notify us promptly if you believe your account has been accessed without authorization.

3.3 Account suspension or closure

We may suspend, restrict, or terminate an account if we reasonably believe that:

these Terms have been violated
fraud or abuse has occurred
a payment has been disputed in bad faith
the account creates legal, compliance, or operational risk
the account is being used for prohibited resale, unauthorized distribution, or unlawful purposes

4. Product information and availability

We try to display product information, descriptions, images, specifications, and pricing as accurately as reasonably possible. However:

colors, finishes, and packaging may vary slightly
availability may change without notice
errors can occur
product compatibility and feature availability may change with updates, regions, or device requirements

We reserve the right to correct errors, inaccuracies, or omissions and to cancel or refuse any order placed using information that was materially incorrect.

Nothing on the Services constitutes a binding offer by us until we accept the order.

5. Orders and contract formation

Your order is an offer to purchase. A contract is formed only when we accept the order and send an order confirmation or otherwise clearly confirm acceptance.

We may reject or cancel an order before or after payment authorization where lawful and appropriate, including where:

the product is unavailable
payment cannot be processed

If an order is canceled after payment has been taken, we will issue an appropriate refund.

6. Prices, taxes, and payment

Prices displayed on the Services may vary by country, route, currency, or promotion.

Unless clearly stated otherwise:

prices do not include optional service charges
shipping charges are shown separately or at checkout
import taxes, duties, brokerage fees, or other border charges may apply depending on route and destination
exchange rates or issuer fees may affect the final charge on your statement

You authorize us and our payment providers to charge the payment method you submit for the total amount due.

We may use third-party payment processors. Your use of those payment methods may also be governed by the processor’s own terms and privacy practices.

7. Shipping, customs, and import compliance

Shipping is subject to our Shipping & Delivery policy.

By placing an order, you confirm that:

the products may lawfully be imported into the destination
you are permitted to receive them
the delivery address is accurate
you will comply with any lawful customs or delivery requirements

You are responsible for understanding the import, use, and possession laws that apply in your destination.

We may cancel, refuse, or restrict an order if we believe shipment would be unlawful, blocked, high-risk, or non-compliant.

8. Returns, refunds, exchanges, and warranty

Returns, refunds, and exchanges are governed by our Returns & Exchanges policy. Warranty matters are governed by our Warranty Info.

Because Libidai sells adult wellness products, some items are subject to hygiene restrictions. Opened or used intimate-use products are generally not eligible for ordinary return unless required by law or approved due to a verified defect or seller-side error.

Nothing in these Terms limits rights that cannot be lawfully excluded under applicable consumer law.

9. Product use, safety, and non-medical disclaimer

Unless expressly stated otherwise, Libidai products are consumer wellness products and are not medical devices.

The information on the Services is provided for general product information only and is not medical, psychiatric, therapeutic, or legal advice.

You agree that you will:

use products only as directed
follow all instructions, warnings, cleaning guidance, and charging guidance
stop use immediately if pain, irritation, overheating, swelling, smoke, unusual odor, or unexpected device behavior occurs
keep products, chargers, packaging, and small components away from children and pets
not use products while driving, operating machinery, or in unsafe circumstances
not use products for unlawful, abusive, or non-intended purposes

We are not responsible for harm resulting from misuse, unauthorized modification, or failure to follow instructions, except to the extent liability cannot be excluded by law.

10. App-Controlled features and software license

10.1 Limited license

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Libidai app and related software solely for personal, non-commercial use with compatible products.

10.2 Restrictions

You may not:

copy, modify, or create derivative works from the app except where law cannot restrict it
reverse engineer, decompile, disassemble, or attempt to derive source code except as permitted by law
bypass security or access controls
use the app with unauthorized hardware, firmware, or commercial automation
interfere with service integrity or performance
use the Services to process unlawful or non-consensual content

10.3 Feature variability

App-Controlled and sync features may vary by:

product model
operating system
app version
device compatibility
permissions granted
regional restrictions
supported playback environments

We do not guarantee that every feature will be available at all times or in every market.

10.4 Permissions and local media access

Certain features may require device permissions such as Bluetooth, notifications, storage access, or local media-related permissions. You are responsible for reviewing and managing those permissions.

You are also responsible for ensuring that any content you connect to or use with app features is lawful and used with all required rights, permissions, and consents.

11. Customer content, feedback, and submissions

If you submit reviews, comments, support messages, images, feature suggestions, or other content to us (“Submissions”), you represent that:

you have the right to submit that material
the Submission does not infringe anyone’s rights
the Submission is not unlawful, abusive, defamatory, deceptive, invasive of privacy, or otherwise improper

To the extent allowed by law, you grant Libidai a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, display, and distribute Submissions for customer service, product improvement, marketing, moderation, fraud prevention, and business operations.

You should not send highly sensitive personal information or private media to us unless requested for support and sent through an approved channel.

12. Intellectual property

The Services, including trademarks, logos, product names, domain names, software, images, text, graphics, audio, video, design, and overall presentation, are owned by or licensed to Libidai and are protected by applicable intellectual property laws.

Except for the limited rights expressly granted in these Terms, no rights are granted to you.

You may not use Libidai trademarks, branding, or copyrighted material without prior written permission.

13. Prohibited conduct

You may not use the Services to:

violate any law or regulation
impersonate another person or entity
submit false age or identity information
engage in fraud, chargeback abuse, or payment abuse
interfere with security, infrastructure, or other users
distribute malware, malicious scripts, or automated scraping tools without authorization
resell products without authorization
upload, transmit, or process unlawful, exploitative, abusive, or non-consensual material
use the Services in a way that could damage Libidai’s operations, systems, users, or legal position

We may investigate and take appropriate action where we suspect prohibited conduct.

14. Third-party services and links

The Services may contain links to third-party sites, app stores, payment services, social platforms, analytics tools, logistics providers, or other third-party services.

We do not control those third parties and are not responsible for their content, terms, privacy practices, or availability. Your use of third-party services is at your own risk and may be governed by separate terms.

15. Privacy and cookies

Your use of the Services is also subject to our Privacy Policy and Cookie Policy. Please read them carefully.

Where required by law, non-essential cookies and similar technologies will be used only with valid consent.

16. Disclaimers

To the maximum extent permitted by law, the Services are provided on an “as is” and “as available” basis.

We do not guarantee that the Services will always be uninterrupted, error-free, secure, or available, or that all content, compatibility information, or third-party integrations will always be complete or current.

Nothing in this section excludes or limits any guarantee, representation, or warranty that cannot be excluded under applicable law.

17. Limitation of liability

To the maximum extent permitted by law, Libidai and its affiliates, officers, employees, agents, suppliers, and licensors will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, data, goodwill, business opportunity, or expected savings, arising out of or relating to the Services, products, app features, or these Terms.

Where liability cannot lawfully be excluded but can be limited, our liability will be limited to the greatest extent permitted by law.

Nothing in these Terms excludes or limits liability for:

death or personal injury caused by negligence where such exclusion is unlawful
fraud or fraudulent misrepresentation
gross negligence or willful misconduct where non-excludable
any consumer right or product liability that cannot lawfully be excluded

18. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Libidai and its affiliates, officers, employees, agents, suppliers, and licensors from claims, losses, damages, liabilities, and expenses arising out of:

your breach of these Terms
your unlawful use of the Services
your misuse of a product
your violation of another person’s rights
your use of content or third-party materials without required rights or consent

This section does not apply where prohibited by consumer law.

19. Compliance, safety, and product withdrawal

If we determine that a product, shipment, feature, or listing creates a safety, legal, or compliance issue, we may take action including:

suspending sale
blocking shipment
removing product listings
requesting customer information needed for safety follow-up
issuing a correction, warning, replacement, refund, recall, or withdrawal notice
cooperating with regulators, marketplaces, and authorities

Customers agree to cooperate with reasonable product safety or recall instructions.

20. Changes to the Services or these Terms

We may update or modify the Services and these Terms from time to time.

Your continued use of the Services after the effective date of updated Terms means you accept the updated Terms, unless applicable law requires a different process.
